This statement by Arkaive, Inc. (“Company,” “we,” “us” or “our”) discloses the privacy policy for the www.arkaive.com website (the “Site”) and the services provided (“Services”) to inform our Site users, (“You” or “Your”) of our policies and procedures regarding collection, use and disclosure of information, including Personal Information, when You use the Site. By using the Site You accept the practices described in this Privacy Policy. This Privacy Policy may be updated from time to time. You are advised to consult this policy regularly for any changes as Your continued used of the Site or Services provided constitutes Your agreement to adopted updated Privacy Policy.

Information We Collect

In the course of Your use of the Site, we collect certain personally identifiable information that may be used to contact or identify You and administer Your account (“Personal Information”). Personal Information may include Your name, mailing address, phone number, and email address. Your credit card number and financial information is not obtained or retained by Site; instead, Arkaive may haves a contractual agreement with a reputable third-party payment processor, which receives Your credit card payment information.

By visiting the Site, our servers record Non-Personal Information from Your browser, including but not limited to, Your browser type, the URL of the previous website You visited, Your ISP, operating system, your geographic location, and Your device ID and information (collectively “Non-Personal Information”). In addition, if You register to use the Services or communicate with us regarding the Site or any of our services or products, we collect any information that You provide to us during the course of our communication.

We may use analytic and reporting technologies to record Non-Personal Information such as Internet domain and host names, Internet protocol (IP) addresses, browser software, operating system types, click patterns, and the dates and times that the Site and our services are accessed by You. We may contract with a third party to help us manage, monitor and optimize our Site and measure the effectiveness of our advertising, communications and use of the Site. We may use web beacons and cookies (described below) for this purpose.

Use of Information for Internal Purpose

Please be advised that when You register for an Arkaive account, You will need to create and username and password to become a User. We advise that You do not disclose Your password to anyone and recommend You guard Your anonymity and sensitive information. In addition, we recommend You sign-out of password-protected services at the end of Your session.

We use the Non-Personal Information we collect to administer our business activities, including tracking use of the Site and providing, maintaining, evaluating, and improving our Site and the services and products we offer and sell. We will also use Non-Personal Information to monitor and analyze use of the Site’s services and for technical administration.

Disclosure of Personal Information to Third Parties

We may contract with and/or employ various third parties to help us provide, maintain and improve the Site and the services we provide and the services and products we offer and sell and such third parties may have access to Your Personal Information in order to perform their services. By using the Services, You expressly authorize our transmission and disclosure of Your Personal Information to the academic institution that You attend, including its administrators and faculty, and Your attendance records. Arkaive complies with Family Educational Rights and Privacy Act (“FERPA”), 10 U.S.C. Section 1232g, requirements relating to Your academic records by using commercially reasonable administrative, physical, and technical standards that are no less rigorous than the standards by which Arkaive protects its own confidential information. Your Personal Information may also be disclosed to comply with legal proceedings, including a search warrant, subpoena, statute, or court order.

Use of Cookies

Like many websites, we use cookies to collect information. A cookie is a small file placed on the hard drive of Your computer or device. We will use cookies to track Your use of the Site, enable certain features of the Site, better understand how You interact with the Site, provide You with a more personalized user experience, and to facilitate Your logging in to the Site by saving Your registration username for future logins to the Site.

How We Protect Your Personal Information.

We consider protecting the security of Your Personal Information as very important. When You enter sensitive information such as a credit card number or Your Paypal information on our registration or order forms, we encrypt that information using secure socket layer technology (sometimes referred to as “SSL”).

If You do desire to obtain a copy of Your Personal Information, You will be required to provide proof of Your identity. If Your Personal Information changes or if You no longer want to subscribe to or use the Site, You may correct, update or deactivate Your Personal Information and Your account through the account management screen. If You wish to deactivate or terminate Your subscription You may also contact us at support@arkaive.com.

Application of Privacy Policy You Access Third Party Websites.

You will be able to access third party websites directly from the Site. This Privacy Policy does not apply when You access third party websites. We cannot control how third parties may use Personal Information You disclose to them or Non-Personal Information, so You should carefully review the privacy policy of any third party website You visit before using their services.

Children’s Privacy.

Company does not and will not knowingly collect or use any Personal Information from children that we know to be under the age of 13. In addition, we will delete any information in our database that we know originates from a child under the age of 13.

If You are between the ages of 13 and 17, You, Your parent, or Your legal guardian may request that we deactivate any of Your Personal Information in our database and/or opt-out from receiving communications from us. If You wish to do so, please contact us at support@arkaive.com.

California Residents’ Privacy Rights

California Civil Code Section 1798.83 permits California residents to request information and obtain from us once a year, free of charge, regarding the disclosure of California residents’ personal information (if any) by us to third parties for the third parties’ direct marketing purposes in the preceding calendar year. Opting-Out From Receiving Communications

You may opt-out from having Your Personal Information used for certain purposes. If You no longer wish to receive any promotional or other communications from us, You may opt-out by emailing us at support@arkaive.com. We also offer You an opportunity to opt-out of certain communications through the account management screen.

CALIFORNIA PRIVACY

This section of the privacy policy provides information to California (“CA”) residents whose personal information is processed pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), whether through the Website or offline. It describes the categories of Personal Information that Arkaive collects, and the purposes for which that information is collected.

This section does not apply to Personal Information that is protected under federal financial privacy laws. Personal Information does not include information that is publicly available or that has been de-identified or aggregated.

Your CA privacy rights

As a California resident, beginning after January 1, 2021, you may have certain rights over the Personal Information we have about you, depending on the type of relationship you have with us.  

We do not offer an opt out of sale link on our homepage for the purposes of the CCPA. We may share Personal Information with our service providers, with third parties with whom we jointly offer products or services, with third parties from whom you request a product or service through us, in the context of a merger, acquisition, bankruptcy, or other corporate transaction, or as otherwise permitted by the CCPA.
